服务条款

1. 服务说明

Hatplan 由 FREEAI LIMITED(地址:10 Aoraki Crescent, Albany Heights, Auckland 0632, New Zealand,以下称「运营方」)运营,为建筑行业雇主提供工地考勤与工时管理服务,包括工人手机 App 与雇主管理后台。使用 Hatplan 即表示接受本条款。

2. 账号

  • 工人账号由雇主在管理后台登记手机号码后开通,App 不提供自行注册;
  • 登录使用发送至登记手机号的短信验证码,账号仅限本人使用,不得转借;
  • 雇主可随时停用其登记的工人账号;工人可在 App 内注销本人账号,详见账号注销说明。

3. 使用规范

  • 如实打卡:上班、下班、转场应在实际发生时、于实际所在地点操作;
  • 不得使用虚拟定位、修改设备时间或其他方式伪造打卡时间与地点;
  • 不得代替他人打卡,雇主授权的代打卡功能除外;
  • 不得干扰、攻击或以自动化手段批量访问服务。

违反上述规范的,运营方或雇主可暂停或终止相关账号。

4. 雇主的责任

  • 确保登记的工人信息、时薪、工资规则与作息设置准确;
  • 依《2020 年隐私法》等法律处理工人个人信息,并告知工人 Hatplan 的使用方式;
  • Hatplan 依雇主设置计算工时与人工成本,相关结果供雇主核对。工资的核算与发放、最低工资、假期与税务合规由雇主负责。

5. 费用

Hatplan 的服务费用由运营方与雇主另行约定,工人使用 App 不产生费用。短信与移动数据费用按工人所用运营商标准计收。

6. 服务可用性

运营方将以合理努力保持服务稳定,但不保证服务不中断或无差错。因维护、升级、网络或第三方服务(推送、短信、地图、会计系统接口)故障导致的中断,运营方将尽快恢复。App 在离线状态下记录的打卡将在网络恢复后同步。

7. 知识产权

Hatplan 软件、界面与相关资料的知识产权归运营方所有。考勤数据归雇主所有。

8. 责任限制

在法律允许的最大范围内,运营方不对间接损失、利润损失或数据使用损失承担责任;运营方就本服务承担的全部责任,以相关雇主在引起索赔事件前 12 个月内实际支付的服务费为限。本条不排除依新西兰《1993 年消费者保障法》(Consumer Guarantees Act 1993)等法律不可排除的权利。

9. 条款变更与终止

运营方可修订本条款,修订后的版本在本页面公布并更新生效日期。雇主终止服务后,考勤记录按隐私政策所述的保存期限处理。

10. 适用法律

本条款适用新西兰法律,争议由新西兰法院管辖。

Terms of Service

1. The service

Hatplan is operated by FREEAI LIMITED (10 Aoraki Crescent, Albany Heights, Auckland 0632, New Zealand, the “Operator”) and provides site attendance and timesheet management for construction employers, consisting of a mobile app for workers and a back office for employers. Use of Hatplan constitutes acceptance of these terms.

2. Accounts

  • Worker accounts are created when the employer registers the worker's mobile number in the back office. The app does not offer self sign-up.
  • Sign-in uses an SMS code sent to the registered number. Accounts are personal and must not be shared.
  • The employer may deactivate a worker account at any time. A worker may delete their own account in the app; see Account deletion.

3. Acceptable use

  • Clock-in, clock-out and site switches must be recorded when and where they actually take place;
  • Mock locations, altered device time or any other means of falsifying time or location are prohibited;
  • Clocking in on behalf of another person is prohibited, except through the proxy function authorised by the employer;
  • Interfering with, attacking, or accessing the service in bulk by automated means is prohibited.

The Operator or the employer may suspend or terminate an account that breaches these rules.

4. Employer responsibilities

  • Keeping worker details, hourly rates, wage rules and schedules accurate;
  • Handling workers' personal information in accordance with the Privacy Act 2020 and other applicable law, and informing workers how Hatplan is used;
  • Hatplan calculates hours and labour cost from the employer's settings for the employer to review. Payroll calculation and payment, minimum wage, holiday and tax compliance remain the employer's responsibility.

5. Fees

Service fees are agreed separately between the Operator and the employer. Workers are not charged for using the app. SMS and mobile data charges apply according to the worker's carrier.

6. Availability

The Operator uses reasonable efforts to keep the service available but does not guarantee that it will be uninterrupted or error-free. Interruptions caused by maintenance, upgrades, network faults or third-party services (push notifications, SMS, maps, accounting system interfaces) will be resolved as soon as practicable. Clock events recorded while the app is offline are synchronised when the connection returns.

7. Intellectual property

The Hatplan software, interface and related materials belong to the Operator. Attendance data belongs to the employer.

8. Limitation of liability

To the maximum extent permitted by law, the Operator is not liable for indirect loss, loss of profit or loss of data use. The Operator's total liability in connection with the service is limited to the fees actually paid by the relevant employer in the 12 months before the event giving rise to the claim. Nothing in these terms excludes rights that cannot be excluded under the Consumer Guarantees Act 1993 or other New Zealand law.

9. Changes and termination

The Operator may amend these terms. The amended version will be published on this page with a new effective date. After an employer ends the service, attendance records are handled according to the retention periods in the Privacy Policy.

10. Governing law

These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction over any dispute.
